In order to have a legal existence, any association must be officially stated near the Minister of Interior Department.With this intention, it is advisable to ask its "recognition".
Who can ask for the recognition of an association?
The request for recognition of an association must be undertaken by one of the principal members of the office (president, secretary-general or treasurer).
Which are the documents required? 
•    A request for recognition of association addressed to the Minister of Interior Department
•    2 specimens of the statutes;on each page of the one of the specimens are affixed a revenue stamp with 1 000 FCFA
•    4 specimens of the list of the founder members including/understanding the indication of their names, first names, date and birthplace, addresses, profession and nationality
•    4 specimens of the official report of the constitutive assembly

3 months.It is proceeded to an investigation of morality of all the members of the office of association.
It relates to its occupations, associative, trade-union, political and its legal antecedents.

An association is a union established between several people in a intention or common interest.It can take several forms with various goals:{mosimage}
association can have a political goal or can seek a lucrative goal in the form of an economic grouping of interest (GIE), being able to undertake activities of any nature (commercial, industrial, artisanal, etc.)in the interest of their members.
In Senegal, the right of association is recognized by the ministry for the Interior.The members of the future association must initially meet in constitutive general assembly in order to discuss:
•    goals and objectives of association to be set up;
•    statutes and rules of procedure which will be adopted by the constitutive general assembly.
Then, the following parts are deposited on the level of the prefecture or the gouvernance of Dakar or other areas of Senegal
•    4 specimens of the official report of the constitutive general assembly
•    4 specimens of the statutes (each page of the original must be stamped

•    4 specimens of the list of the founder members
(name first name - age - profession - nationality - addresses)
•    4 specimens of the list of the members of the elected office
The persons in charge for association will receive later a convocation of the police force for an investigation of morality.After opinion of the authority, a receipt of association will be given to the persons in charge.The receipt is the official declaration of the constitution of association.

A nongovernmental Organization (ONG) can be defined like an association or organization deprived regularly declared, with nonlucrative goal and having the aim of working for the interest of the populations and to bring a support to the development of the country and is approved in this quality by the government.
To have a statute of nongovernmental Organization, association réquérante must have activities on the own territory and be stated during two years.It addresses a letter of application as ONG to which an assessment of activities of these two years of existence is joined.This request is accompanied by a file including/understanding:
1. statutes of association in two specimens with the address of the seat,
2. the receipt of declaration for associations sénégalaises, the foreign organizations the authorization or the act of recognition of the country of origin,
3. the list of the principal members of the body of direction with the precise information of their age, nationality, profession and of their address,
4. a memorandum presenting association or the private organization requiring,
5. a work programme specifying the possible sources of financing.   
Within two month to more as from its date of filing, the file of approval is examined by a commission which studies the file and delivers an approval.
Approval is a ministerial decree delivered by the ministry for the Woman, the Family and the social Development (ministry of supervision of the NGO).It makes it possible association to have a statute of NGO which can intervene on the extent of the own territory, but also to obtain a particular mode (exemption of straight and taxation of materials, materials and equipment, the temporary admission of the vehicles of utility use assets or locally bought or imported for the realization of the programs of ONG etc…).
To ask an opinion of registration carrying attribution of a national identification number of the companies and associations (NINEA).
Any organization exerting in Senegal must appear in a repertory of the companies, establishments and associations providing him a satisfactory identification to facilitate its administrative steps.
The national identification number of the companies and associations (NINEA) is the single number by which an organization is recorded in this repertory.

European NGOS in Senegal

Definition of NGOS According to the decree 96-103 of 08/02/96 journal in Senegal, Non-Governmental Organizations are associations or private bodies regularly reported to non-profit and with the purpose of lend their support to the development of Senegal and approved in this quality by the government. Thus, any body acting in Senegal n is not necessarily be regarded as NGOS.
Procedure for approval to qualify f
or the recognition as NGO, the agencies or national associations must file with the Ministry of the family, Social Development and of National Solidarity a dossier of the following documents:

• their statutes in two (02) copies
• List of the principal members of the governing body with an indication of their age, nationality, occupation and address
• a memorandum l association or l organization
• a program indicating the sources of financing and more producing parts requested from the national organizations, agencies and foreign associations must provide
• a receipt (or Act) of recognition of NGOS in the country of origin
• The Policy rationale at least two years in The country The file is transmitted to the Ministry of Interior to ensure that is issued, NGOS, a "Authorization d exercise" also called "Authorization d implantation » d a Foreign organization.

A survey on the leaders of the organization is then entrusted to Interpol. The application for authorization to exercise may be filed directly to the Ministry of the Interior before the 2 years exercise in Senegal but the application for recognition as NGOS will occur after two years.

The procedure of obtaining a bearing opinion national identification number of the companies and associations (NINEA) must be initiated by:For the people morals (GIE, associations, companies, NGO):the person in charge for the structure.
